I. Statutory Basis
Article 2.2 of the "Marriage Registration Ordinance" (No. 387 of the State Council Decree) The registration office involving of Chinese citizens marriage with foreigners, and mainland residents marriage with the residents of the Hong Kong Special Administrative Region (hereinafter referred to as Hong Kong residents), residents of the Macao Special Administrative Region (hereinafter referred to as Macao residents), Taiwan regional residents (hereinafter referred to as Taiwan residents), and overseas Chinese is an office that is established and managed by the provincial, autonomous regional and municipal people's government or by the civil affairs departments of the provincial, autonomous regional and municipal people's government.
II. Eligibility for Application
Marriage Registration
1. Male over 22 years old, while women over 20 years old;
2. The parties engaged shall have no spouse (i.e. unmarried, divorced, or widowed ) ;
3. By mutual consent;
4. No lineal consanguinity relationship or no collateral relationship within three generations;
5. One of the parties shall have a permanent residence in Jiangsu Province;
6. Both of the men and women are required to apply for marriage registration at the marriage registration office;
7. Both parties shall have full civil capacity (No intellectual disabilities and mental disorders) .
Divorce Registration
1. Whose marriage registration shall have been handled in mainland China or Chinese embassy (or consulate);
2. Divorce by Consent;
3. A divorce agreement has been reached;
4. Both have full civil capacity;
5. One of the parties shall have a permanent residence in Jiangsu Province;
6. Both of the men and women are required to apply for divorce registration at the marriage registration office.
